Supreme Court Decision on MBBS Course Fee in Kerala

In a recent hearing made in the apex court of India, it has been directed to the State’s Admission and Fee Regulatory Committee in Kerala to fix a non-exploitative and reasonable fee from 2017-18 onwards for MBBS admissions. The new judgment on MBBS Course Fee in Kerala has come as a relief both for students and self-financing Private Medical Colleges in Kerala.

 

 

The bench led by Justice L. Nageswara Rao has directed the Committee to take the required actions within 3 months by re-examining the proposals of the managements of Medical Colleges in Kerala for the fixation of fee 2017-18 onwards. This decision came in after hearing three rounds of litigations by the State, management of Private Medical Colleges in Kerala and the students of the state.

The apex court also cleared in the judgment for MBBS Course Fee in Kerala made by the High Court in 2019 which had asked the committee to check whether the fee proposed was not excessive and to eliminate any element of profiteering or collection of capitation fee. Justice Rao without getting into the merits of the fee structure of any individual college by confirming to the principles of fee fixation laid down in the 2017 Act. While he confirmed that unaided professional institutions have the autonomy to decide on the fee to be charged, committee shall ensure that the fee is non-exploitative and reasonable.

Agreeing with the High Court, the apex court said that the fee structure for MBBS courses in private aided and unaided colleges was beneficial neither for the institutions nor the students and the committee should reconsider the proposals of the private self-financing colleges for fee fixation from 2017-18 onwards and come out with their respective proposals for fee fixation within 3 months.
